GENERAL TERMS AND CONDITIONS

1. INTRODUCTION

1.1 All of the Terms and Conditions listed above shall together be referred to as "the Terms" or "Agreements".

1.2 In the Terms and Conditions, any terms covering "bet" or "betting" will refer to sports, casino, poker and other luck games played with real or virtual money over PokerKlas website. Further on aforementioned terms will also be referred to as "Services". Any terms consisting of "you", "your", "customer" or "player" is the reference to any person using the PokerKlas or the Services of PokerKlas and/or any registered customer of PokerKlas. "We", "us" and "our" terms will further on refer to PokerKlas company.

1.3 Please not that Responsible Gambling Policy, Terms of Use, Privacy Policy, Betting Rules, Sports Betting rules and regulations, Casino Betting rules and regulation and any rules and regulation applicable to the Services of PokerKlas are to be considered an inseparable part of the Terms. Any conflict situation will be reviewed in cross reference among all the terms and conditions, rules and regulations and any applicable policies, mention herein and found in the website.

1.4 It is at the discretion PokerKlas to amend or change the General Terms and Conditions at any given time.

2. OPENING AN ACCOUNT

2.1 Players are subject to knowing the rules and regulations for online betting of their residing jurisdiction.

2.2 It is forbidden for those residing in USA, Israel, British Virgin Islands, Philippines, and Dutch Antilles to open accounts. Those who are identified to be in these jurisdictions (temporary or other, national or using those countries IP's) will be subject to their bets being revoked at the discretion of PokerKlas and only their initial deposit being refunded.

2.3 PokerKlas always audits the website’s capacity to offer its services inside the regions that are not effectively incorporated into the list of forbidden territories. When PokerKlas is not in a position to further provide its services to a particular region (let that be for legal, commercials or any other reasons), PokerKlas will revise and refine the relevant area of The Terms as it needs to be.

2.4 At times when another region is added to the list of forbidden territories by PokerKlas, customers’ accounts who is identified to be residing in such restricted region will be closed immediately. In cases, where the customer identified to be residing in a newly restricted region, has placed the bets on evets, which have not been completed at the time his/her residence territory was included into the forbidden territories list, PokerKlas retains the right to interpret such bets as voided, consequently refunding customers’ stakes. In cases, where a customer has placed a combined stake with accumulated winnings for events both, completed and those which have not occurred yet during the times that the customer’s residing territory has been included into the forbidden territories list, PokerKlas will exclude the events, not yet completed, from the betting coupon and treat the settled events as they stand by re-computing the odds respectively. Taking into consideration afore mentioned, after re-computing, where a customer has a positive balance, such will be paid out to him/her in accordance to the The Terms sections 6 ‘Payments’ and 6 ‘Winnings’.

2.5 The accessibility of PokerKlas website should not be interpreted by the customer as a vindication of PokerKlas’s providing gambling services in the regions where such services are forbidden under the law or any other regulatory rules and by far such accessibility under no circumstances should be perceived by a customer as the site’s constitution of a service offer, imposition of the latter or invitation to engage in any of the site’s services. By no means PokerKlas is responsible for any breach of a law or a regulation as a consequence of the customer’s utilization of PokerKlas’s services.

2.6 PokerKlas only accepts customers that are over eighteen (18) years old or any legal age at which gambling or gaming activities are under the law or jurisdiction that applies to them. Those players that are not at the legal age will have their accounts closed.

2.7 You agree to provide accurate registration information, including without limitation your correct date of birth, your country of residence, current address, telephone and identity details. You agree to inform us of any changes in such details.

2.8 In cases where customers’ accounts are not used for 30 months or the whereabouts of the customer is unknown, PokerKlas reserves the right to revoke the account balance. No applications may be made to the authority for revoking accounts under such circumstances.

2.9 Employees, former employees of service providers and/or affiliated people are not permitted to open betting accounts and cannot exploit the services and promotions of PokerKlas. Same rules apply to family members of the above mentioned. Violation of this rule will result in the account being permanently closed and the referred accounts will be considered as fraudulent. Any winnings derived from such activities will be deemed as forfeited by the account holder and only the deposited amount will be returned to the account holder.

2.10 PokerKlas will not tolerate any language which is considered to be defamatory, abusive, obscene, racist, sexist, discriminatory, or other way offensive towards any Company staff and reserves the right to close accounts without any warning should such incident take place.

3. YOUR PERSONAL GAMING ACCOUNT

3.1 The name on Your Account must match Your true, legal name and identity. Your financial transactions (account funding options) must match the name of the credit card or other payment accounts through which You fund the account or withdraw money from Your account. Any inconsistency in name details between your gaming and depositing accounts will be considered as the breach of The Terms, your account balance will be the subject to suspension on such occasion.

3.2 Our Know Your Customer program requires all customers with deposits and withdrawals to submit proof of identity, proof of address and payment ID where applicable at any given time. To verify Your identity, at any time We reserve the right to request satisfactory proof of identity, including but not limited to copies of a valid passport/identity card/driving license and/or any satisfactory documents to proof the identity; satisfactory proof of address, including but not limited to a recent utility not older than three months. The necessary reviews will be performed within the reasonable time frame.

3.3 To maintain a high level of security in accordance with Anti-Money Laundering and Counter-Terrorism Financing Act 2006 and integrity in the system, we reserve the right to conduct a security review at any time to validate your identity, age and/or the registration data provided by you (a 'Security Review'), in order to verify your use of PokerKlas Services. This may include, but is not limited to, your compliance with these Agreements and the policies of the PokerKlas and your financial transactions carried out via the Services for potential breach of any of the terms and conditions of PokerKlas and any applicable laws. You authorize us and our agents to make any relevant inquiries of you and for us to use and disclose information to any third party whom we consider necessary in order to validate the information you provide to us in accordance with these Agreements, i.e. ordering a credit report and/or otherwise verifying the information against third party databases. In addition, to facilitate these Security Reviews, you agree to provide such information or documentation as we, at our unrestricted discretion, may request. Whilst we are undertaking any Checks from time to time, we may restrict you from withdrawing funds from your account and/or prevent access to all or certain parts of PokerKlas Services. Please note that we may from time to time re-perform the Checks for regulatory, security or other business reasons.

3.4 It is an offence under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 to provide false and misleading information about your identity. As a result, in certain circumstances, where the originally supplied documents have been considered unsatisfactory, are suspected to be fraudulent or suspected to be obtained from a third party to perform illegal operations over the Internet, contain information only in the country’s local language (excluding English), we may have to contact You and ask You to provide further information or information in the internationally accepted format, including but not limited to requesting official translations of legal documents with appropriate seals, in order to complete the Checks. Failure to pass the Checks may result in permanent closure of Your account and suspension of any of the account outstanding balance.

3.5 Should customers refuse to provide documentation, not provide at all or provide documentation not meeting the criteria (forged, altered, failing security checks etc.). PokerKlas reserves the right in such circumstances to close players’ accounts immediately and revoke their account balances. In such event, customers will lose their rights to all winnings. Customers are also advised that their deposit may not be refunded in such event.

3.6 As part of Verification Checks, we may make use of third party agencies to confirm Your age, identity, address and payment details. This process will involve checking the disclosed details against certain (public or private) databases. By entering into this process, you agree that we may use, record and disclose such personal information and this data may be recorded by us or them. For Your protection, any telephone calls with us may be recorded and monitored.

3.7 PokerKlas does not permit registration of more than one (1) account in connection with your use of site’s Services including but not limited to its web-based version. If you register for or create multiple accounts, PokerKlas reserves the right to terminate any and all account(s) held by you. Should PokerKlas believe, using its absolute and sole discretion, that you have:

1. registered and/or used more than one account; and/or
2. acted in collusion with one or more other individuals through a number of different PokerKlas accounts to play on the same combination of matches/events (regardless of whether or not such bets are struck separately, at a range of different prices or on different days)

in an attempt to exceed the maximum pay-out for an individual account holder across linked accounts, it reserves the right to withhold any winnings arising from such behavior.

3.8 PokerKlas reserves the right to confiscate any funds or winnings created by fraudulent activity related to multiple accounts. Should We have reasonable grounds to believe that multiple accounts have been opened with the intention to defraud the company, we reserve the right to cancel any transaction related to said fraud attempts. Any accounts containing but not limited to the same personal information, bank account, IP address or else shall be considered "Duplicate Accounts". Any Duplicate Accounts may be closed by us immediately; account balances will be deemed as forfeited by the holder. In such an event the deposit will be the subject to control check form the PokerKlas. In case where fortification of the documents or any other account related fraudulent activities have led the company to suffer any losses, the equaling amount will be withdrawn from the deposit of the player.

4. UTILIZATION CONDITIONS FOR YOUR USE OF PokerKlas SERVICES

4.1 You understand that you may lose money on placed bets and accept that you are fully responsible for any such loss. You accept that under no circumstances will any amounts lost by you under any bet be recoverable from us.

4.2 It is your responsibility to verify that you are permitted to bet with us according to the jurisdiction of your domicile or habitual residence and/or in which you are located and you agree that you will not bet with us while you are located in a jurisdiction which prohibits you from betting with us.

4.3 You undertake to use our services for legitimate betting purposes only. In particular, you undertake not to

1. engage in any activity which has the purpose or effect of causing damage to or in any way hindering our business operations or generating or increasing a liability on us, including without limitation any tax, levy or duty collecting authority;
2. transmit information that assists in the placing of bets or wagers on any sporting event or contest from any territory where it is illegal to do so; and/ or
3. procure or otherwise arrange, whether directly or indirectly, for a third party to transmit information that assists in the placing of bets or wagers on any sporting event or contest from any territory where it is illegal to do so.
4. disguise or interfere in any way with the IP address of the computer you are using to access the site or otherwise take steps to prevent us from correctly identifying the actual IP address of the computer you are using whilst accessing the site;
5. register a betting account using other than their own personal information;
6. act on behalf of a third party;
7. deposit money derived from illegal operations;
8. deposit money using a credit card that is not authorized for the customer to use. Commit fraud together with a third party and conspire to use such credit card to obtain money;
9. use personal or third party accounts for money laundering or other illegal activities;
10. sell-off transfer account to others.

4.4 It is important to note that due to the current anti-money-laundering regulations, the player may deposit money into the PokerKlas account only in order to play and use our Services. Likewise, the player may only withdraw winnings and not the funds deposited into the PokerKlas account. Players who deposit and withdraw without gaming activities will have their funds blocked until further notice. PokerKlas is not a financial institution and does not grant interest on deposits. In any case, PokerKlas reserves the unlimited right to apply certain restrictions to the payment methods in selected countries and/or for certain players.

4.5 We will take all reasonable steps to prevent activities of money laundering and PokerKlas is bound by international audits to ensure this does not happen. Global anti money laundering procedures and parameters are in place to identify risks of money laundering and financing terrorism.

4.6 Necessary steps towards any and every account will be performed in order to examine financial habits and behaviour to evaluate customer transactions legitimacy according to the PokerKlas’s Terms and Conditions and for the customers’ risk profile

4.7 PokerKlas Services are meant only to be used for recreation purposes for all users. If PokerKlas suspects any account being used for any purposes other than recreational, the account may be limited as per PokerKlas commercial decision under risk management protocols.

5. DISCLOSURE OF USERNAME, PASSWORD, (PokerKlas’S) PERSONAL ACCOUNT DETAILS

5.1 Customers are advised to create a minimum 6-character password containing numbers and letters. Customers should refrain from choosing a password that is similar to their username or any other common information.

5.2 The username, password and other registered information on your personal account selected by you during registration for membership should not be disclosed to any third party. In case where a third party has gained access to your personal account with the PokerKlas by any means other than PokerKlas, you are solely responsible for the state of your funds and any personal information stored in your account.

5.3 You agree to keep your username, password and other personal information secret and confidential and to disallow the use of it to any third party.

5.4 It is the customers’ responsibility to ensure the safe keeping of their username and security details. If there is a suspected violation, customers are required to take necessary measures to cancel their previous security information and request new log-in details.

5.5 Customers are required to provide the correct user details when logging in or communicating with PokerKlas.

6. PAYMENTS

6.1 It is possible to deposit money to PokerKlas account by transferring via mobile phone number. Notification of new payment methods will be made on our homepage and sent by e-mail as they are added. For each new depositing method, the Terms and Conditions will be updated accordingly.

6.2 Cepbank transactions are made by sending from the account to the registered mobile phone number. This is a fast and secure way of sending money and can be made through Your designated bank found on the deposit page. Full details on the process of this transaction can be found on the corresponding deposit page from your chosen bank.

6.3 Once the deposit request is made and the form fully complete, it will take from 15 minutes up to 2 hours for the funds to reach PokerKlas accounts. Any delay over this period should be reported to PokerKlas customer support.

6.4 Players are only permitted to use their personal information and personal bank accounts. Players are responsible to ensure the information given on the deposit form is correct.

6.5 Player information provided on the deposit form must be identical to the player data held by PokerKlas. Withdrawals from an account can only be addressed to the person registered on the account.

6.6 Players can make a withdrawal request from any of the banks listed on the PokerKlas withdrawal page. The number of banks will increase over time and further withdrawal methods will be added. New additions will be included to our homepage and adequate notifications will be sent out by e-mails as they are added. Correspondingly, withdrawal Terms and Conditions will also be updated.

6.7 Providing there are no discrepancies in your withdrawal request, the withdrawal request will be processed within 24 hours. The time-frame is not guaranteed and delays may occur from time-to-time (account and information verification, public holidays, bank working hours etc.).

6.8 Your account will be debited the moment you make the withdrawal request. Withdrawal requests can be made each day.

6.9 If a problem occurs with your withdrawal request, the process will be cancelled and the funds re-instated to Your account.

6.10 If there is a bonus amount in your account, you must first satisfy the turn-over terms of the bonus before making a withdrawal request.

6.11 Players can only make a withdrawal request once they fully use their initial deposit amount.

6.12 Player information provided on the withdrawal form must be identical to the player data held by PokerKlas. Withdrawal requests made to other parties will not be taken into consideration.

7. ELECTRONIC SERVICES PROVIDER

7.1 In order to use the Services of the PokerKlas, you will be required to send money to and may be required to receive money from us. We may use third-party electronic payment processors and/or financial institutions ('ESPs') to process such financial transactions. You irrevocably authorize us, as necessary, to instruct such ESPs to handle account deposits and withdrawals from your account and you irrevocably agree that We may give such instructions on your behalf in accordance with your requests as submitted using the relevant feature on our platforms.

7.2 You agree to be bound by the regulations imposed by each applicable ESP. In the event of conflict between these Agreements and the ESP's regulations, these Agreements shall prevail.

8. WINNINGS

8.1 The bet office finalizes the calculations on the initial results. Subsequent disqualifications and cancellations will not affect the calculations.

8.2 The earnings will be multiplied by the identified rates.

8.3 The winnings will be transferred to player accounts once the bets are completed

8.4 Customers are liable to inform the company of any and all additional credits to their account as a result of incorrect transactions. Otherwise, any and all earnings associated to this transaction will be revoked and funds reversed to PokerKlas company’s account.

8.5 Where the user's account falls below zero balance after a previously closed bet is recalculated, the player must deposit to bring the account balance to zero or above. Until this is done the company will block the account.

8.6 The account the customer will use for withdrawal needs to be under the customer’s name.  Otherwise withdrawal requests will not be taken into consideration.

8.7 The player acknowledges and accepts not to make cancellation or refund requests to the payment method used for making a deposit. In an event where a deposit process is refunded or reimbursed to the user, the company will take action to receive full payment including costs from any accounts that were used for improper deposits. Any improper transactions identified where the account is used for any transactions other than betting activities to transfer funds to the player account will result in the company requesting additional fees from the customer for costs incurred (regardless whether the account is suspended).

9. LIVE BETTING

9.1 Any statistics displayed during a live event (i.e. Score, time etc.) is only intended for general information. There is no guarantee to the validation and should not be considered when placing bets.

9.2 The wagered bets will be held in pending mode and then will either be accepted or cancelled.

9.3 Bets in the pending mode will be cancelled if during the time a significant change has taken place in the market.

9.4 The company reserves the right to suspend bets to any market without prior notification.

9.5 Where the company has reasonable doubt to believe bets being wagered after the results are posted or wagered during a technical malfunction that provides the user with an unfair advantage by placing wrong odds, the company, in these circumstances reserves the right to countermand the bets.

10. PRIVACY

10.1 We are required by law to comply with data protection requirements in the way in which we use any personal information collected from You in Your use of the PokerKlas Website. We therefore take very seriously our obligations in relation to the way in which we use Your personal information.

10.2 By providing us with the information, you consent to our processing your personal Information for the purposes set out in the Terms, for operating the PokerKlas Website or to comply with a legal or regulatory obligations.

10.3 As a company policy, no personal information is shared to any third party other than to those that are bound to provide a service that requires access to such information.

10.4 We will retain copies of any communications that you send to us (including copies of any emails) in order to maintain accurate records of the information that we have received from You.

11. PokerKlas PROMOTIONS AND UNSOLICITED E-MAIL POLICY

11.1 If a player entrusts PokerKlas with his/her e-mail address, he explicitly agrees, unless specified otherwise, to receiving communications on products, services and special offers from PokerKlas via e-mail which are deemed to be of interest to the players. Such subscription can be cancelled at any time by the player. If the player would like to cancel the communications on products, he will be deleted from the mailing list within three days after receipt of an email sent to PokerKlas contact e-mail addresses with the word "UNSUBSCRIBE" in the reference line.

11.2 All bonuses and promotional offers are subject to the terms and conditions made available when communicating the bonus offer. In principle, all bonuses and offers refer only to the individual recipient of the promotional communication and may be used only once during a stipulated time frame. Promotional offers cannot be redeemed in cash, but remain subject to the specific bonus conditions. PokerKlas reserves the unlimited right to reclaim any bonuses and promotional offers as well as the winnings decried from such bonuses if the player has obtained the offer by fraud or devious means.

11.3 If groups of players acting in collusion or as a syndicate or individual players who register several times, set up fictitious accounts or use front men attempting to take unfair advantage of the bonus offers, PokerKlas reserves the right to bonus amounts, cancel any winnings made with these bonus offers, and close accounts. Non-recreational players and those trying to misuse bonus promotions are restricted from the promotions. PokerKlas reserves the right to terminate or change any bonus offer at any time.

12. FRAUDULENT ACTIVITIES, PROHIBITED TRANSACTIONS AND DEPOSIT CONFIRMATIONS

12.1 We have a zero tolerance policy towards inappropriate play and fraudulent activity. This includes, but is not limited to; game manipulation or payment fraud, or manipulation of the multi-currency facilities, fraudulent payment, including but not limited to the use of stolen credit cards, or any other fraudulent activity (i.e. chargeback or other reversal of a payment) or prohibited transaction (i.e. money laundering) or the failure on the part of your bank or ESP to honour your transactions. Any such fraudulent activity will have its result in account closure. Any winnings derived from such activities will be revoked and the deposited amount will be a matter of further checks by PokerKlas and may not be returned to the account holder.

12.2 If, in our sole determination, you are found to have cheated or attempted to defraud us and/or the Group or any other user of any of PokerKlas Services in any way, we reserve the right to suspend and/or close your account and recover bad debts using any method which is lawfully available to us including, but not limited to:

1. debiting the amount owed by you from your account;
2. instructing third party collections agencies to collect the debt. This may have a detrimental impact on your credit rating and will require us to share your personal information (including your identity) with the appropriate agencies.

13. FORFEITURE & ACCOUNT CLOSURE

13.1 We reserve the right, at our unrestricted discretion and in relation to your account, any related ESP (as that term is defined at clause 7.1 and 7.2) account, any accounts you may have with other sites and/or casinos and/or services owned or operated by or on our behalf and, in the case of your use of the gaming services, any services that have the shared game/table platform, to terminate these agreements, withhold your account balance, suspend your account, and recover from such account the amount of any affected pay-outs, bonuses and winnings if:

1. you are in breach of any of these Agreements;
2. we become aware that You have used or attempted to use the Services for the purposes of fraud, collusion (including in relation to charge-backs) or unlawful or improper activity (including, without limitation, any manipulation of the multi-currency facilities);
3. we become aware that You have played at any other online gaming site or services and are suspected of fraud, collusion (including in relation to charge-backs) or unlawful or improper activity;
4. you have 'charged back' or denied any of the purchases or deposits that you made to your account;
5. you become bankrupt or equivalent proceedings occur anywhere in the world;
6. it is proven by the relevant courts with a verdict entered into legal force that you have violated international or local money laundering provisions.

14. ENTIRE AGREEMENT, MODIFICATION AND AMENDMENTS

14.1 You fully understand and agree to be bound by these Agreements and as modified and/or amended by us. We may amend these Agreements at any time without prior notification of the new terms, however, all the new Terms and Conditions will be published or/and modified on the relevant page of the PokerKlas or any location through which you access the Services. Any such modification will take effect within fifteen (15) days of publication. If any modification is unacceptable to you, you may terminate your Agreements with PokerKlas by closing your account. Your continued use of the Services following the change of terms and conditions or Agreements between you and PokerKlas and/or once the modification has been implemented will be deemed as acceptance of the modifications.

14.2 It is your sole responsibility to review these Agreements and any amendments each time You access the Services. Any modified Agreements (and the documents referred to therein) represent the complete and final Agreement between You and Us and supersede any and all prior Agreements between You and Us.

15. MISCELLANEOUS

15.1 Please note that these Terms and Conditions of PokerKlas Services shall prevail in the event of any conflict between these Terms and Conditions of PokerKlas Services and any of the game rules or other documents referred to in these Terms and Conditions of PokerKlas Services.

15.2 IF THESE AGREEMENTS ARE TRANSLATED INTO ANOTHER LANGUAGE, THE ENGLISH LANGUAGE VERSION WILL PREVAIL IN THE EVENT OF ANY CONFLICT BETWEEN THE TRANSLATION AND THE ENGLISH LANGUAGE VERSION.

15.3 PLEASE PRINT THESE TERMS AND CONDITIONS AND STORE THEM FOR YOUR FUTURE REFERENCE. IN ADDITION, WE SUGGEST THAT YOU PRINT AND STORE ALL TRANSACTION RECEIPTS AND GAME RULES AS APPLICABLE TO YOUR ACTIVITIES.
